This Policy may be updated at any time, to ensure it is as relevant as possible.
The Policy includes but is not limited to the information below. Learning Express Toys of Fort Collins will use discretion in dealing with any situation that falls outside of the following information.
At Learning Express Toys of Fort Collins we always aim to provide our customers with the best service possible. We believe this includes creating Item Limits on rare/popular items to ensure as many of our customers as possible do not miss out on their newest collectables. We do not support reselling at exorbitant prices, which is why during a Pre-Order we will often impose Item Limits Per Customer. LEFoCo.com reserves the right to limit the purchase of any items on this site.
Products sold on our website are for end-user customers only and are not for resale. We reserve the right to refuse or cancel any order if we suspect you are purchasing products for resale. Further, if we suspect you are purchasing for the purpose of reselling we may block your access to our site.
By purchasing on our website, you agree to be bound by these Terms and Conditions of sale and all other site policies.
At Learning Express Toys of Fort Collins we put our customers first, which means we do impose certain Item Per Customer limits on rare, hard to find, and popular products. In addition to this, in relation to our customers' own safety on our website, we also run Fraud Analysis Checks, which show when multiple orders have been processed using the same information. This is for the benefit of our customers and so we are the first to become aware if something has gone wrong in any way. This information may be used for any order processing. This information is not shared, sold, or otherwise used outside the business purposes of this website.
The below Terms & Conditions include any items purchased in a larger quantity than is permitted, whether this is in the same order or if it is in separate orders or that item is duplicated in a set.
Terms & Conditions
If any item states 'Limit Per Customer' or 'Limit' or 'LIMIT' or 'Limit (n)' [n would be a number representing the limit] with or without a number amount, in any section of the title, product description, product image ribbon, etc., Learning Express Toys of Fort Collins reasonably assumes this to be adhered to. This may be a Pre-Order item, or it may be a regular item.
Individual items that are part of sets that are added to the same or subsequent order, are included in this limitation, even if the set has no limits.
If any item stating the above is purchased in a quantity in excess of the limit, your entire order, or the duplicate item, may be cancelled and refunded immediately, or any time until it has shipped.
Please note, any refunds from cancellations are initiated by us immediately, however the funds may take between 2-7 business days to arrive back into the account. The delay is caused by the processes of the banks.
According to our Cancellation Policy (see Cancellation Policy page) we do not charge Cancellation Fees for this type of Cancellation.
We are not required to inform you that the item is about to be cancelled as it is assumed that by placing an order on this website all customers are aware of the rules, particularly those listed on product pages and are seen before purchase. However as a courtesy, we often send an email about this beforehand. You will also receive an automated cancellation email and/or text message.
Your order may be cancelled due to the 'Item Limit Per Customer' Policy for reasons including but not limited to:
- Duplicate Address on Orders
- Duplicate Email Address on Orders
- Duplicate Phone Numbers on Orders
- PayPal Email Address/Account Information
- Credit Card Name Information (Fraud Analysis)
- Other Fraud Analysis Failure
- Cross channel (lefoco.biz and learningexpress.com/foco) orders for a limit 1 item
- Multiple Orders Using the Same IP Address
- More than one of a design - this applies to Exclusives Limit items only.
- Items in a set
Learning Express Toys of Fort Collins will always use discretion in determining if an order has been duplicated, using the above information and anything else at our disposal. We will attempt to use two or more reasons before cancelling an order under the Item Limit Per Customer Policy; however we may cancel an order if only one reason is valid.
If an Item has once had an Item Limit, but it is no longer stated on any titles or product pages or image, there is no longer a Limit Per Customer.
Learning Express Toys of Fort Collins maintains the right to refuse service to any customer and cancel without notice any order for any order deemed in our sole discretion to have violated this policy, including repeat offence of the Item Limit Per Customer Policy. This includes but is not limited to blocking/banning customers from this website or social media accounts.
We do not tolerate any form of bullying or harassing behavior in regards to any decisions made, or otherwise.
*!* COVID-19 Pandemic Related Delays *!*
There are still shipping delays in the wake of COVID-19. Packages can be in transit for extended periods. Check your tracking info for estimated delivery
(estimated by the carrier, not us).
We charge flat rate shipping depending on location and order size. Shipping cost is visible once you begin the checkout process. The amount charged covers packaging and actual shipping costs. We continuously look for less expensive ways to ship but all carries have again increased their costs.
If your package is missing after the carrier marks the shipment as "Delivered" there is nothing we or the carrier can do to replace your shipment. To fight this there are two options: require a signature for package release to recipient or hold the package for customer pickup (FedEx Only).
Services to thwart Porch Pirates:
- Signature Required (USPS or FedEx) +$5.55
- Hold for PickUP (FedEx Only) +$3.00
These services are available in the Check Out process shipping page. The additional costs are direct to carrier, not to us .
- We work very hard to get all orders out as soon as we are able!
- We pick, pack, and ship Monday-Friday, most Saturdays, and some Sundays when things are really busy. However, our outgoing packages are only picked up M-F for FedEx and M-F for USPS.
- Unless your order is a pre-order or we are otherwise engaged, (e.g. emergency; unforeseen circumstances; attending Comic Con, seasonal events or busy holiday periods, etc.) we make every effort to ship on the same day we receive your order.
- If there is a delay in processing your order, such as an item being out of stock, you will be contacted and we will ship your order out as soon as possible.
- We do not offer expedited service.
We are not responsible for any additional customs fees, taxes, and tariffs. Also, we cannot ship merchandise as a "gift", this would be falsifying documentation and illegal.
We ship to:
- United States including APO/FPO and US territories.
- Canada (temporarily suspended)
If you are in another country, or a US Territory (Guam, Puerto Rico, etc.), please contact us to organize shipping to you. We will quote shipping costs from our contracts with FedEx, UPS, DHL, and the USPS.
Pre-Order Shipping Rules
If the item is a Pre-Order, you accept on purchase that we do not yet have the item in stock, and from the time we order our stock and receive it, occasionally there are changes to the item(s) that are not communicated with us. If this occurs, we will contact you about your order and you will be refunded in full for items we have to drop from your order. Pre-order items' orders are processed "First Received, First Fulfilled" and are prioritized over regular orders.
Return to Sender
Should a package be marked as "Return to Sender" by the shipping carrier due to Insufficient Address or any other reason, customers will be refunded for the product cost only. These orders are not eligible for a refund of the original shipping cost.
Right to Cancel
LEFoCo will limit the sale of any items. These will be marked as such on the product page. Items sold on our site are intended for our end-user customers only and not for resale. Therefore, we reserve the right to refuse sale and/or cancel any order we suspect is being placed by a reseller.
Change of Mind Returns
We offer 30 day returns on all products sold as long as the product is in the unopened shipping box/poly-bag. You will be required to pay for the return shipping cost. Importantly, the item must not be taken out of the packaging. If it was shipped in a factory seal we cannot accept it for a return.
You must request a return before sending your item back to us. If we have not approved a return it will be refused. Email us at firstname.lastname@example.org to begin the return process. If your return is approved, an RMA email will be sent with instructions on how to proceed. Return shipping costs are the customer's responsibility.
Damaged, Missing, Incorrect Goods
On the rare occasion your goods arrive damaged, something is missing or the wrong item was delivered, please contact us within 7 days of receiving your item. We will require photos of damaged/imperfect items.
Exceptions / non-returnable items
We cannot accept returns for sale or clearance items, gift cards, or items shipped in factory sealed packaging.
In the end, if we made a mistake or there is some other problem with your order, we'll do our best to make it right!
